Sample Case #4

WJ, after drinking at a party, mistakenly turned into someone else's driveway and hit their fence. The owner of the house came out and discovered WJ behind the wheel of the Lincoln he had been driving. The owner called the police and WJ was arrested for DUI. The charge was filed in Oklahoma County District Court and his license was ordered revoked based upon WJ's refusal of the test.

At the hearing for the revocation of his license, our firm was successful in getting his license restored. The wreck had occurred on private property and on a driveway. The case law argument which we based on PP's earlier case showed that the crime could not have been committed WHERE the cop found him. A motion to dismiss the case in Oklahoma County District Court was successful based upon the same argument. WJ was ONLY convicted of being drunk in public.
