1. The Police Officer didn't read me my Miranda rights.
A) It isn't required for Police officers to read Miranda warnings for a DUI arrest in PA.
2. Even If I was sober, I couldn't of passed the field sobriety testing.
A) If you give them this insight, you have just "pleaded guilty" that you were driving drunk.
B) There are a variety of reasons that you could fail the test other than by consuming alcohol.
3. My driving was fine.

A) Who is saying this? You or the police officer?
4. If I had a couple of drinks, should I tell the police officer when he asks?
A) Drinking and driving is legal and many do not understand this. Drinking alcohol to the point when you are impaired and over the legal limit of 0.08%, than this is illegal. You can tell the officer “yes”, but give no other information.
5. I was not informed that field sobriety tests were an option in PA.
A) You have a choice to give into Field sobriety tests. However, the officer is not required to inform you.
B) It is recommended not to perform these tests, say no and be be nice about it.
6. I passed the field sobriety testing.
A) Are you 100% sure? The police officer didn't tell you what a
passing or failing score was, it is the officer’s opinion.
B) It is recommended to tell the the officer; “I can’t do these tests
when I'm not even drinking sir.” You have just "plead guilty" of drinking prior to the stop.
7. I am paranoid of needles, so I performed the breath test instead.
A) This is not your decision; it is the police officer’s decision in the matter.
B) Breathe testing that is performed roadside does not count.
8. Can I get ARD?
A) Everyone charged with DUI/DAI in Pennsylvania makes it so the ARD program is not available to them.
9. How do I Apply For An Occupational Limited License in PA?
A: Applications are permitted in these rare circumstances.
