WEST VIRGINIA - MANDATORY PENALTIES FOR DUI CONVICTIONS (CHARGES ARISING 5/5/04 & AFTER)

1. West Virginia adopted the .08 BAC standard set forth in Senate Bill 166 on February 16, 2004. The new standard goes into effect at 12:01 a.m. on May 5, 2004.
